EFCC restricts/ review night operations

 



The Economic and Financial Crimes Commission, EFCC, has recently revised its guidelines pertaining to the arrest, bail, and processing of suspects. This comprehensive review, effective from Monday, October 31, 2023, is anchored in the imperative of upholding the rule of law and aligning with international best practices in suspect treatment.

The directive was issued in Abuja on Wednesday, November 1, 2023, in response to the apprehension of 69 suspected internet fraudsters by operatives of the Ibadan Zonal Command of the commission in Ile-Ife, Osun State. In the aftermath of the arrests, a significant number of suspects, duly profiled by the Command, have already been released. The ongoing profiling of yet-to-be-released suspects will be expedited without any unnecessary delays.

The updated guidelines place paramount emphasis on safeguarding the rights of suspects, particularly in matters of arrest, detention, and bail. Operational procedures are now expressly aligned with relevant provisions of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Administration of Criminal Justice Act, 2011, and the EFCC’s Standard Operating Procedures, SOP.


Under this new directive, EFCC operatives are explicitly prohibited from requesting professional certificates of sureties as a condition for bail. Furthermore, the demand for the international passport of suspects will be exercised judiciously, taking into consideration the nature of the case, the individual's personality, and their country of residence.


Commander of the EFCC, CE Sylvanus Tahir, SAN, who heads the Legal and Prosecution Department, cautioned against unreasonable bail conditions, emphasizing that such conditions should be reasonable and practicable for suspects and their sureties. Tahir also stressed the cessation of the unwarranted detention of suspects beyond the constitutionally allowed period without a Remand Warrant.


Officers within the Commission are explicitly warned against violating the rights of suspects without just cause. Tahir urged a commitment to professionalism in all operational activities, emphasizing a paradigm shift towards adhering to the best international standards, reinforcing the EFCC's identity as a flagship law enforcement agency. click here for more stories
